GENERAL USERS AGREEMENTThe following terms represent a binding agreement between you, the user, and The Germany-USA Career Center.
1. ENTIRE AGREEMENT:
a. The Germany-USA Career Center reserves the right to modify the terms and conditions of this agreement or provide additional usage requirements in its sole discretion at any time by posting a revised version hereof. User's continued use of the site after the revised changes constitutes user's acceptance to the revisions.
b. Usage of The Germany-USA Career Center including registering, searching or posting jobs, and searching or posting resumes, implies acceptance of these terms and conditions.
We assume no liability or responsibility for the content submitted by the users of this site. The Germany-USA Career Center is not responsible for the accuracy of posted jobs and/or posted resumes.
a. Advertisers and Users of The Germany-USA Career Center retain the sole responsibility for content of advertisements and resumes and all applicable laws, regulations and standards.
b. All employers, recruiters, agencies and job seekers posting adverts or resumes on this site must adhere to commonsense business ethics. This includes: No obscene, discriminating, libelous, defamatory, sexually explicit, misleading or false information.
c. The Germany-USA Career Center is not a placement agency or recruiting firm and we do not guarantee that jobs or resumes posted will result in candidates being contacted or hired or jobs filled.
d. All contents on this site, including the job and resume database, are the sole property of The Germany-USA Career Center.
e. The unauthorized use of spiders, robots, or any other such device to navigate or search any area of this website is prohibited.
f. The Germany-USA Career Center reserves the right to suspend the services of this site to any individual for any reason.
3. COPYRIGHT: All site Content, including logos, text, graphics, software, animation, Search Engine and Databases are the sole property of The Germany-USA Career Center, and are protected by U. S. and International copyright laws. You may not reproduce, modify, display, distribute or sell the content. This also applies to HTML code used to generate Web pages on The Germany-USA Career Center.
4. NO WARRANTIES:
The site is provided by The Germany-USA Career Center on an 'As Is' basis. The Germany-USA Career Center makes no warranties, express or implied, including the warranties of merchant ability, fitness, for a particular purpose, or non-infringement with respect to its services or the site, or the functionality, performance, content or results of use thereof.
5. PRIVACY: The Germany-USA Career Center is committed to protect the privacy of its users. We use our best efforts to ensure that any information you provide will remain private and confidential. The Germany-USA Career Center is not responsible for any action that an employer may take should they find an employee's resume in the resume library. The Germany-USA Career Center obtains personal information from job seekers, companies and recruiters on a voluntary basis only. The Germany-USA Career Center stores resumes and jobs in its secure database. The Germany-USA Career Center does not sell or trade users' personal information.
6. GOVERNING LAW AND JURISDICTION:
The provisions of this Agreement and the legal relations between the parties arising out of this Agreement will be governed and construed in accordance with the laws of the Commonwealth of Massachusetts. Guarantor hereby irrevocably and unconditionally submit to the jurisdiction of any court of competent jurisdiction located in Barnstable County, State of Massachusetts in any action arising out of or relating to this Agreement and users irrevocably and unconditionally agree that all claims with respect to such action or proceeding may only be heard in a court located in Barnstable County, State of Massachusetts.
7. LIMITATION OF LIABILITY:
Any liability of The Germany-USA Career Center under this Agreement, whatever the basis of the liability, shall not exceed $100.00 for any transaction out of which the liability arose or occurred. Neither The Germany-USA Career Center nor its agents, officers, directors or employees shall be liable for indirect, special or consequential damages.
EMPLOYERS & RECRUITERS
1. RESUME ACCESS POLICY:
a. All subscribers to the Resume Library must be Employers and/or Recruiters ("the Client"). The resume database is to be accessed and used solely by the subscribing client, for internal use only, for the purpose of recruiting candidates for open job opportunities. Client may not distribute, sell or disclose any resumes or provide Resume Library access to third parties.
b. The Germany-USA Career Center Resume Library is provided as an information service only. The applicants listed have not been screened. Information is based on applicants' submissions and the Germany-USA Career Center will not be responsible for its accuracy. Potential employers will be responsible to verify the information obtained through the Germany-USA Career Center. Employers and applicants are solely responsible for meeting the legal requirements for accepting employment in the U.S. or in Germany.
c. The privacy of Germany-USA Career Center applicants must be respected. Candidates may be contacted only for specific legitimate job openings. Client may not download or scan resumes to populate a resume database or mailing list. Client may not contact candidates for any other purpose, such as sending unsolicited e-mails.
d. The Germany-USA Career Center does not allow access to the resume database by any other job board, nor by any persons representing or acting as agents for any other job board. Unauthorized copying of job postings to post on other job boards is not permitted. Copying resumes or e-mail addresses to generate traffic for other job boards is prohibited and will result in legal action. Only candidates can apply to the positions through the Germany-USA Career Center. Any entity that violates the provisions contained in this paragraph agrees to pay The Germany-USA Career Center a fine in the amount of $25,000.00 per occurrence, plus reasonable attorneys' fees and costs, within five (5) days after receipt of written notice from The Germany-USA Career Center or its representative(s) describing the violation in question.
2. JOB POSTING POLICIES:
a. Submitting or posting hyperlinks or HTML code is not acceptable except in data fields designated for that purpose.
b. Each job posting must advertise a specific position. Job titles listing positions in general terms like "Interns" or "Engineers" are not permitted. The Germany-USA Career Center reserves the right to alter or deny job postings that do not comply with its posting policy.
All sales of Germany-USA Career Center services and products are final. Payment by invoice is due upon receipt. The Germany-USA Career Center reserves the right to revise job posting fees, resume library access subscription fees and other service or product charges without prior notice.
4. SECURITY: The Germany-USA Career Center uses the highest level of encryption to ensure the security and safety of its clients' personal and credit card information. Credit card information is not saved in its database.
5. SEVERABILITY AND WAIVER:
If any provision of this Agreement is found to be invalid, unenforceable, or illegal, the invalidity of that provision will not affect any of the remaining provisions.
6. ATTORNEYS' FEES:
Clients/users of the Germany-USA Career Center will reimburse The Germany-USA Career Center for any and all attorneys' fees and other collection costs and expenses paid or incurred by The Germany-USA Career Center or their agents in the legal enforcement of this Agreement. This includes fees incurred by collecting any amounts due or resulting from any breach of this Agreement.
